By accessing or using the Check platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

Check is a dependency health dashboard platform designed for software developers and engineering teams. Our Service allows you to analyse dependency health, monitor maintenance signals, and get insights into package viability to help you avoid abandoned dependencies.

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorised use of your account
• While we don't verify age, you must be legally capable of entering into binding contracts

You agree not to use the Service to:

• Upload, store, or transmit any content that is illegal, harmful, threatening, abusive, or violates any laws
• Attempt to gain unauthorised access to our systems, other users' accounts, or connected integration services
• Use the Service for any fraudulent or deceptive practises
• Interfere with or disrupt the Service, servers, or connected third-party services
• Violate the terms of service of any connected integration (GitHub, monitoring platforms, etc.)
• Use the Service to access or manipulate data you are not authorized to access
• Violate any applicable local, national, or international laws

• We perform regular backups of all user data and service metadata
• Data recovery is performed only when necessary and at our discretion
• Integration tokens and credentials are stored securely using industry-standard encryption
• We are not liable for any data loss, though we make reasonable efforts to prevent it
• Data from connected integrations is cached temporarily and subject to the availability and policies of those third-party services

• We strive to maintain high service availability but do not guarantee 100% uptime
• Our hosting provider maintains a 99.9% Service Level Agreement
• We may perform scheduled maintenance that temporarily affects service availability
• We are not liable for any losses resulting from service interruptions

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We provide the Service "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim
• We are not responsible for any business losses, lost profits, or data loss

You agree to indemnify and hold harmless Acertine Ltd from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

• We may modify or discontinue the Service at any time with reasonable notice to users
• We may update these Terms from time to time, with material changes communicated via email or platform notification
• Continued use of the Service after changes constitutes acceptance of the new Terms

• If we cannot resolve disputes directly, they will be governed by the laws of England and Wales
• Any legal proceedings must be brought in the courts of England and Wales

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
